Unauthorized Use of Employer’s Vehicle with Intent to Return: Constituting Theft under Thai Criminal Law

Issue:
Whether the servant’s act of taking and using his employer’s car with a duplicate key, intending to return it later, constitutes theft under Thai criminal law.

Under Section 334 of the Thai Criminal Code, theft is committed when a person dishonestly takes property belonging to another.

Analysis:
The defendant secretly made and used a duplicate key to access and take the car without the owner’s consent.
