Liability for Unintentional Homicide Following an Attempt to Conceal the Act

Mr. Yai assaulted Mr. Lek by striking him with a wooden object until Mr. Lek lost consciousness. Believing that Mr. Lek had already died, Mr. Yai subsequently hanged him from a tree in order to create the appearance of suicide. As a result, Mr. Lek ultimately died.
In this case, Mr. Yai is criminally liable for unintentional homicide. Although he lacked the intent to kill at the initial stage, his subsequent act of hanging Mr. Lek—under the mistaken belief that the victim was already dead—constituted a negligent act that directly caused death. This aligns with the principle established in Supreme Court Decision No. 1395/2518.
