Transferred Intent in Assault Causing Injury

Mr. Yai attempted to punch Mr. To, but Mr. To successfully evaded the attack. As a result of the attempted punch, Mr. To lost balance and collided with Mr. Lek, causing Mr. Lek to fall and suffer the loss of three teeth.
Although Mr. Yai did not directly strike Mr. Lek, his intentional act was directed at Mr. To. The injury to Mr. Lek occurred as a consequence of that intentional act. This constitutes a case of transferred intent (aberratio ictus), where the harmful result affects a person other than the intended target.
Under Section 60 of the Thai Penal Code, the offender shall be deemed to have intended the result against the person who actually suffered the harm. Therefore, Mr. Yai is considered to have acted with intent toward Mr. Lek.
Conclusion:
Mr. Yai is criminally liable for intentional assault causing bodily harm to Mr. Lek under Sections 60 and 295 of the Thai Penal Code.
