Trespass and Destruction of Property Without Intent to Steal

Legal Issue:
Whether Piw’s act of entering Paew’s bedroom and disposing of a photograph constitutes theft or other criminal offences.

Legal Analysis:
Piw unlawfully entered Paew’s bedroom at night without permission, thereby constituting trespass. The photograph, although originally given by Pin, had already become Paew’s property. Piw took the photograph and discarded it into a river. However, such taking was not for the purpose of wrongful gain or appropriation for himself or another. The intent was solely to destroy the property.

Therefore, the element of “dishonest appropriation” required for theft is not satisfied. Instead, Piw’s conduct demonstrates intent to cause damage to another’s property.

Conclusion:
Piw is not liable for theft. He is criminally liable for trespass and mischief (causing damage to property) under Sections 358 and 365 of the Thai Penal Code.
