Property Damage Between Spouses Under Thai Penal Code

Mr. Akkhee quarreled with his wife because of her habitual nightlife activities. In a fit of anger, he gathered two newly purchased sets of his wife’s clothing and placed them on the ground in front of their house before intentionally setting them on fire. His wife immediately rushed in and extinguished the flames by stomping on the burning clothes. As a result, one set of clothing was damaged, causing a loss valued at approximately 300 Baht.
In this case, Mr. Akkhee has committed the offense of damaging another person’s property by fire under the Thai Penal Code. However, since the damaged property belonged to his lawful spouse, he is exempted from punishment pursuant to Section 71 of the Thai Penal Code, notwithstanding that the act itself remains legally wrongful.
